MILLIKARE BUYER TERMS OF USE

These Buyer Terms of Use form part of the MilliKare Terms of Service. By accessing, creating a Buyer account or making any purchase on MilliKare, you agree to be legally bound by these Terms and all MilliKare policies incorporated herein. If you do not agree, do not use the platform.

1. Eligibility and Account

1. Buyers must be at least 18 years old or the age of majority in their province or territory, whichever is greater.
2. By using Millikare, buyer represent and warrant that they have the legal capacity to enter into these Terms.
3. Buyer agrees to provide accurate, current, and complete registration information during account registration.
4. MilliKare reserves the right to verify Buyer identity and to suspend or terminate accounts for any reason at its sole discretion.
5. Buyers are responsible for maintaining account confidentiality and for all activity conducted through their account. Notify us immediately of any unauthorized access.
6. Buyer may not share their account or use another person’s account without permission.

2. Purchases and Orders

1. Millikare only connects buyers with multiple sellers. Each seller is responsible for their products, fulfillment, and product compliance.
2. Product descriptions, images, pricing, and health claims are provided by Sellers. While MilliKare verifies regulatory compliance documentation, it does not independently verify the accuracy of all Seller content. Buyers are encouraged to read product labels and exercise independent judgment.
3. All prices are in Canadian dollars (CAD) unless otherwise specified. Applicable taxes, shipping charges, and other fees are added at checkout prior to order confirmation.
4. Orders are subject to Seller acceptance and product availability. MilliKare reserves the right to cancel any order at any time for any reason, including suspected fraud, pricing errors, or stock issues.
5. By completing a purchase, the Buyer authorizes MilliKare’s payment processor to charge the selected payment method for the full amount of the order.

3. Compliance Verification – Buyer Acknowledgement

1. Every product listed on MilliKare has been verified by MilliKare to hold a valid Health Canada licence (NPN, DIN-HM, or CNF) at the time of listing. This verification is a platform safeguard; it is not a warranty of product safety, efficacy, or fitness for any individual Buyer.
2. Health Canada compliance verification does not replace professional medical, nutritional, or health advice.
3. Buyers with specific health conditions, allergies, or those who are pregnant, nursing, or administering products to children should consult a qualified healthcare professional before purchasing any NHP, supplement, or personal care product.

4. Payment

1. Payments are processed through secure third-party payment gateways. MilliKare does not store full payment card data.
2. Buyers authorize the applicable payment method to be charged for orders, fees, and applicable taxes at the time of checkout.
3. In the event of an unauthorized transaction, buyers must notify their financial institution promptly as required by the applicable card network rules.
4. Buyers acknowledge that MilliKare’s maximum liability for payment processing errors shall be limited to the value of the specific transaction affected.
5. Chargebacks initiated without first following MilliKare’s dispute resolution process may result in account suspension.

5. Shipping, Delivery, and Risk

1. Shipping is the responsibility of the Seller. Estimated delivery times are provided for guidance only and are not guaranteed.
2. Risk of loss and title for products purchased on MilliKare pass to the Buyer upon delivery of the product to the carrier by the Seller.
3. MilliKare is not liable for delivery delays, carrier errors, customs hold, or force majeure events beyond its reasonable control.
4. Buyers must inspect orders upon receipt and report any damage, loss, or discrepancy within 7 calendar days of delivery to info@millikare.ca.

6. Returns, Refunds, and Cancellations

1. Buyers must follow Millikare’s Return and Refund Policy, available on the platform.
2. Refunds will be issued for valid returns according to seller and platform policies.
3. Products must be returned in their original condition, sealed, and unused unless the return is due to a defect.
4. Certain product categories (opened personal care, supplements, and baby products) may be subject to restricted return eligibility for health and safety reasons.
5. Refunds will be issued to the original payment method within 10 business days of MilliKare receiving confirmation of the valid return.
6. MilliKare is not responsible for the cost of return shipping unless the return is due to Seller error.

7. MilliKare Rewards Program

Buyers may earn MilliKare Reward Points (“Points”) through eligible purchases and qualifying activities. Points are governed by the current MilliKare Rewards Program Terms, which are incorporated herein. Key terms:

1. Points have no monetary value outside the MilliKare platform and are not transferable, exchangeable for cash, or redeemable on other platforms.
2. MilliKare reserves the right to modify, suspend, or terminate the Rewards Program at any time with reasonable notice.
3. Points will expire if a Buyer’s account is inactive for more than 3 consecutive months.
4. Points accumulated through fraudulent, reversed, or refunded transactions will be forfeited.

8. Prohibited Buyer Conduct

You agree not to:

• Misuse or attempt to manipulate the platform, including false, misleading, or defamatory product reviews or ratings.
• Resell or reproduce the products purchased on MilliKare without the Seller’s prior written consent.
• Infringe third-party intellectual property or violate any applicable law.
• Circumvent MilliKare’s systems or policies.

9. Disclaimer and Limitation of Liability

MILLIKARE IS AN INTERMEDIARY MARKETPLACE AND IS NOT THE SELLER OR MANUFACTURER OF ANY PRODUCT. ALL PRODUCT LIABILITY RESTS WITH THE APPLICABLE SELLER. MILLIKARE’S MAXIMUM LIABILITY TO ANY BUYER FOR ANY CLAIM SHALL NOT EXCEED THE PURCHASE PRICE OF THE SPECIFIC PRODUCT(S) AT ISSUE. MILLIKARE IS NOT LIABLE FOR ADVERSE HEALTH EFFECTS, ALLERGIC REACTIONS, OR PRODUCT MISUSE.

Buyers acknowledge that natural health products, supplements, and personal care products carry inherent risks of adverse reactions in some individuals. Buyers use such products at their own risk after exercising appropriate due diligence.

10. Governing Law

These Buyer Terms of Use are governed by the laws of the Province of Ontario and applicable federal Canadian law. All disputes shall be resolved in accordance with the Dispute Resolution provisions of the MilliKare Terms of Service.

11. Changes to Terms

Millikare may update these Terms at any time. Continued use of the platform constitutes acceptance of changes.
